OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to electrocution from using a Mark 1 Voltage Detector with fiberglass reinforced plastic rods that had not been tested to confirm that the fiberglass reinforced plastic rods were safe for use in live line tools:    On or about October 16, 2014, at the Metal Shredders, Inc., DP&L/Metal Shredders industrial substation, a site-supervisor was exposed to an electrocution hazard by using a Mark I Voltage Detector equipped with fiberglass reinforced plastic rods that were approximately 15 years old and that had not been tested to confirm that the fiberglass reinforced plastic rods were safe for use in live line tools.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

The employer did not provide additional training on being a qualified person to a site-supervisor on the electrical safety-related work practices before entering into the 4.16kv DP&L/Metal Shredders, Inc. dual-access substation on October 16, 2014 to de-energize and test the electrical disconnect switchgear in Cabinet #3.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. The employer had not developed a safe procedure for deenergizing circuits including the middle switch blade on the electrical switchgear within a DP&L/Metal Shredders, Inc. 4.16kv dual-access substation that was stuck in the closed position before entering the substation on October 16, 2014 that included procedures such as but not limited to; the use of PPE for the arc flash hazard and how to test the electrical lines with a voltage detector. 29 CFR 1910.333(b)(2)(iii)(A): A lock and a tag shall be placed on each disconnecting means used to de-energize circuits and equipment on which work is to be performed, except as provided in paragraphs (b)(2)(iii)(C) and (b)(2)(iii)(E) of this section. The lock shall be attached so as to prevent persons from operating the disconnecting means unless they resort to undue force or the use of tools.    On or about October 16, 2014, in the DP&L/Metal Shredders, Inc. dual-access substation, the site supervisor who threw the disconnecting means on the 4.16Kv electric switchgear inside Cabinet #3 did not place a lock and tag on the disconnecting means. On or about October 16, 2014, inside the DP&L/Metal Shredders, Inc. dual-access substation, a site supervisor was using a Mark 1 Voltage Detector on a three phase 4.16KV electrical switchgear inside Cabinet #3, and was not qualified to perform the testing due to the failure identify any voltage due to the middle knife blade being stuck in the closed position on the electrical switchgear and still energized, 2400 volts to ground. 29 CFR 1910.335(a)(1)(i): Employees working in areas where there are potential electrical hazards shall be provided with, and shall use, electrical protective equipment that is appropriate for the specific parts of the body to be protected and for the work to be performed.   Note: Personal protective equipment requirements are contained in subpart I of this part.    On or about October 16, 2014, inside Cabinet #3 of the DP&L/Metal Shredders, Inc. dual-access substation, a site supervisor who was using a Mark 1 Voltage Detector to test for the absence of voltage on the 4.16Kv electrical circuits was exposed to burns and electric shock, electrocution hazards from the inadequate use of body, and hand protection based on the risk while Cabinet #3 was open and he was testing the three phase electrical lines for voltage. 29 CFR 1910.333(b)(2)(iv)(B): A qualified person shall use test equipment to test the circuit elements and electrical parts of equipment to which employees will be exposed and shall verify that the circuit elements and equipment parts are deenergized. The test shall also determine if any energized condition exists as a result of inadvertently induced voltage or unrelated voltage backfeed even though specific parts of the circuit have been deenergized and presumed to be safe. If the circuit to be tested is over 600 volts, nominal, the test equipment shall be checked for proper operation immediately after this test.    On or about October 16, 2014, an unqualified site supervisor tested the 3 phase electrical switchgear located in Cabinet #3 of the 4.16kv DP&L/Metal Shredders, Inc. dual-access industrial substation.  The site supervisor utilized a Mark 1 Voltage Detector to test the 3 phase 4.16 kv electrical lines which showed one of the three phase legs still energized around 2400 volts.  The unqualified site supervisor did not check the Mark 1 Voltage Detector for proper operation before and immediately after the test.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
