29 CFR 1926.100(a):   Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:      a)  Worksite, Lido Blvd., Lido Beach NY - Employee was exposed to being struck by overhead tools and roofing materials while working in a JLG Articulating Boom, directly below overhead work; on or about 10/20/14.      Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:      a)  Worksite, Lido Blvd., Lido Beach NY - Employee was engaged in roofing activities while working from the bucket of a JLG 660SJ Articulating Boom.  The employee was approximately 20ft above the ground and was not tied off to the boom or basket; on or about 10/20/14.      Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.    a) Worksite, Lido Blvd. Lido Beach NY - Employees were exposed to falling approximately 20ft while installing a rubber roof on a commercial building; on or about 10/20/14.    Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.    Milcon Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 683658, citation number 01, item number 01 and was affirmed as a final order on 6/4/13, with respect to a workplace located at 1090 Hicksville Rd. Massapequa NY 11758.
