29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates or markings were not maintained in a legible condition:    a) Shop area: The employer allowed employees to operate the Hyster forklift (no identification available) without a legible nameplate.  The nameplate which contains all information pertinent to that specific forklift, had a nameplate that was covered with soil, grease and dirt making it not legible, exposing employees to tip over/crushed by hazards.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:   a) Shop Area; The employer did not ensure that each employee operating Powered Industrial trucks were evaluated at least once every three years to ensure that they are competent to operate a forklift in a safe manner.  The last evaluation was performed on March 21, 2007.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication training did not include an explanation of the Global Harmonization System (GHS) with respect to the labeling, pictograms, and safety data sheets, including the order of information and how employees could obtain and use the appropriate hazard information:  a) Throughout the Facility:  The employer did not provide training to employees on the new hazard communication standard Global Harmonized System (GHS) that took effect December 1, 2013. Employees were not familiar with the new hazard communication standard.  Employees were exposed to hazardous chemicals in the workplace, such as but limited to, propane, sealer clear paint, and lacquer thinner.
