29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer is failing to protect employees from potential fall hazards associated with framing a new residential apartment building with unprotected sides and edges where the fall was in excess of 6 feet. The most recent example of this was found on the job site located at 8801 S. 33rd Street, Lincoln, NE 68516 where the employer had employees framing a new apartment building without the use of fall protection thus exposing them to multiple fall hazards during the build. Instances observed by the CSHO include but are not limited to: i. Employees exposed to the unprotected floor opening adjacent to the staircase located on the west side of the building and used by employees to access the second floor from the ground floor. The lack of guard railing leaves employees exposed to a 105 fall hazard. ii. Employees exposed to the unprotected floor opening located above the staircase located on the west side of the building. The lack of guard railing leaves employees exposed to a 21 fall hazard.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around each hole: The employer is failing to protect employees from potential fall hazards associated with framing a new residential apartment building with unprotected floor openings where the fall was in excess of 6 feet. The most recent example of this was found on the job site located at 8801 S. 33rd Street, Lincoln, NE 68516 where the employer had employees framing a new apartment building where they were using a job site constructed ladder to access from the second to the third floor without having a guard rail around the top of the access point thus exposing employees to a fall hazard of 11 feet.

The most recent example of this was found on the job site located at 8801 S. 33rd Street, Lincoln, NE 68516 where the employer had employees framing a new apartment building without the use of fall protection thus exposing them to multiple fall hazards during the build. Instances observed by the CSHO include but are not limited to: i. Employees walking and working along the top of an interior wall (constructed of 2x4s) of the building without fall protection while exposed to an 18 foot fall. ii. Employees using a 2x8 as a walking platform between the trusses to move along the top of the building without fall protection while exposed to an 18 foot fall.

29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section:Note: Circumstances where retraining is required include, but are not limited to, situations where (1) Changes in the workplace render previous training obsolete; or (2) Changes in the types of fall protection systems or equipment to be used render previ The employer is failing to retrain employees that fail to demonstrate a comprehensive understanding of the fall protection requirements as presented in this subpart with adequate fall protection training necessary to inform employees about the potential fall hazards associated with framing a new residential apartment building where the fall hazards range from 6 feet to 21 feet. The most recent example of this was found on the job site located at 8801 S. 33rd Street, Lincoln, NE 68516 where the employer had untrained employees framing a new apartment building without the use of fall protection and exposed to multiple fall hazards during the build. Instances observed by the CSHO include but are not limited to: i.
