29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards; Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.     The employer is failing to protect employees from potential fall hazards associated with working near inadequately protected edges exposing employees to a fall hazard over 130 feet.  This was most recently evident during the inspection of the facility located at 70454 Highway 61, Binkelman, NE 69021; where the employer has employees working in close proximity to a damaged guard rail that runs along the outside edge of the top of the grain bins.  Instances include but are not limited to:   i.  Employee taking a bin measurement of bin # 110, walked to edge of the bin to verify employee inside the bin had exit prior to dropping a plumb bob inside, put hand on the railing and the railing broke loose.   ii. Employees since the initial breaking of the railing have continued to take bin measurements which require them to approach the edge of the bins and look over the railing to verify the employee inside has exit the bin.   Employees perform maintenance on the equipment located on top the bins near the damaged railing thus exposing them to an inadequately protected fall hazard.    Gavilon Grain, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(c)(1), which was contained in OSHA inspection number 314054925, Citation 1 Item 1 and was affirmed as a final order on ?, with respect to a workplace located at 1995 E. County Road 50, Paxton, NE 69155.
