29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) Employees were exposed to the hazard of falling approximately two stories while performing carpentry work from the top level of the building without the benefit of fall protection. b) Employees were exposed to the hazard of falling approximately one story where fall protection was not provided at and around floor holes on the second story of the building. Hernandez Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(13) which was contained in OSHA inspection number 947505, citation 1, item 3, and was affirmed as a final order on January 29, 2014, with respect to a worksite located at 1435 Rue Paris Ave., Inverness, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
