29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites: a) On or about 10/22/14 at the Fashion Outlets of Niagara Falls located at 1900 Military Road, Niagara Falls, New York; in the west corridor next to the Mrs. Fields store, an employee cleaning tile was using a shop vacuum that was plugged into an extension cord. There was no ground fault circuit interrupter or assured equipment grounding conductor program in use. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used: a) On or about 10/22/14 at the Fashion Outlets of Niagara Falls located at 1900 Military Road, Niagara Falls, New York; in the east corridor at the stairs, an employee was using a mixing drill with a damaged cord. b) On or about 10/22/14 at the Fashion Outlets of Niagara Falls located at 1900 Military Road, Niagara Falls, New York; at the north end of the west corridor near the Nike Store, the extension cord from the temporary power post supplying the portable power tools had the outer jacket peeled off. NO ABATEMENT CERTIFICATION REQUIRED
