29 CFR 1926.405(b)(2): In energized installations, each outlet box did not have a cover, faceplate, or fixture canopy: a) On or about 10/22/14 at the Fashion Outlets of Niagara Falls located at 1900 Military Road, Niagara Falls, New York; at the Forever21 Store, an employee was applying joint compound to finish drywall. The employee removed the cover of a live 120 volt receptacle to finish around the opening. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: a) On or about 10/22/14 at the Fashion Outlets of Niagara Falls located at 1900 Military Road, Niagara Falls, New York; at the Forever21 Store, an employee was applying joint compound to finish drywall adjacent to a 120 volt receptacle. There was no cover in place and the receptacle was still live. NO ABATEMENT CERTIFICATION REQUIRED
