29 CFR 1926.20(b)(3): Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation: a) On or about 6/14/16, in Bldg 4, Mechanical Room 115, on construction site at the Orchard Heights Care Community, 5200 Chestnut Ridge Road, Orchard Park, NY: A Corr C-175 Super Heavy Duty Floor Machine was available for use in a room where an employee of the company was working. The machine lacked a ground prong on its plug and was not locked out, nor was it identified as unsafe by a tag. NO ABATEMENT CERTIFICATION REQUIRED
