29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1): a)T-Brothers Industries, LLC: Employees (construction workers) worked around disturbed thermal system insulation materials from pipes which was directly adjacent to asbestos containing thermal system insulation. The employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material in the immediate work place. 29 CFR 1926.1101(k)(9)(vi): Training for employees performing Class IV operations did not include available information concerning the locations of thermal system insulation and surfacing asbestos containing material and/or presumed asbestos containing material, asbestos-containing flooring materials, or flooring material where the absence of asbestos has not yet been certified; and instruction in recognition of damage, deterioration, and delamination of asbestos containing building materials; and did not take at least 2 hours: a) T - Brothers Industries, LLC: Employees (construction workers) worked around disturbed thermal system insulation materials from pipes which was directly adjacent to asbestos containing thermal system insulation. The employer did not provide training for the employees consistent with EPA requirements for traning of local education maintenance and custodial staff of set forth at 40 CFR 763.92(a)(1). On or about October 21,2014.
