29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:     (a) On or about October 16, 2014, Brian Pierce Roofing, LLC., as the controlling employer, did not ensure that portable ladders, used to access upper landing surfaces, extend at least 3 feet above the upper landing surface to which the ladders were used to gain access. Employees of Alejandro Estrella Roofing, LLC., a subcontractor, were observed using a ladder to access the roof of a commercial building. Ladder did not extend at least 3 ft above the landing platform and was not tied to the roof edge. 29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    (a) On or about October 16, 2014, Brian Pierce Roofing, LLC., as the controlling employer, did not ensure that employees of Alejandro Estrella Roofing, LLC., a subcontractor, were protected from falls while working at heights greater than 6 feet. Employees of Alejandro Estrella Roofing, LLC., were exposed to fall hazards in excess of 9 feet while engaged in roofing activities on the roof of a commercial building with no fall protection in place.      Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").    Brian Pierce Roofing, LLC., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 540599, citation number 1, item number 1 and was affirmed as a final order on August 24,2012, with respect to a workplace located at 2241 Rainbows End Point, Colorado Springs, CO 80915.
