29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards were not guarded with a standard railing and toe board. a) Nissin Brake Ohio, Inc. located in Findlay, Ohio; On or about September 27, 2014 the employer failed to guard a platform placed over zinc plate tanks to clean v-holders (contacts) on the Zinc #1 dip tank line. Employees were exposed to fall hazards and contact with toxic chemicals.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. a) Nissin Brake Ohio, Inc. located in Findlay, Ohio; On or about November 11, 2014 the employer failed to evaluate the respiratory hazards for those employees who were exposed to hydrogen chloride during the refilling of the hydrogen chloride dip tank.
