29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about 10/16/14, at the jobsite @ 5520 Castleberry Road, Cumming, GA 30040, employees were exposed to the following forklift safety hazards:     a)Employees were observed operating the forklift extended above the manufacturers recommendation which cause the forks to jump into the direction of an employee's face; b) the forklift was driven up to an employees face standing on the scaffold;  c) an employee was observed kneeling under the forks of the forklift; and d) the employer did not ensure the forklift operator was trained to safely operate the forklift.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

The employer failed to provide a safe means of egress and access for the two buck high scaffold.
