29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  On or about October 28, 2014, employees were exposed to chemical hazards when the employer did not have a hazard communication program for employees using chemicals such as, but not limited to, Hardie Plank Siding which contains respirable crystalline silica.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical: (Construction Reference: 1926.59)  On or about October 28, 2014, employees were exposed to chemical hazards when the employer did not have a  a safety data sheet for each chemical in use.  Employees used chemicals such as, but not limited to, Hardie Plank Siding which contains respirable crystalline silica.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  On or about October 28, 2014, employees were exposed to chemical hazards when the employer did not provide employees information on the location of the program and MSDS or provide employee training.  Employees used chemicals such as, but not limited to, Hardie Plank Siding which contains respirable crystalline silica.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.  On or about October 28, 2014, employees were exposed to fall hazards of approximately 11 feet when the employees were installing siding on a house from a pump-jack scaffold with no fall protection.  Hector Salamanca was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 891196, citation number 1, item number 2 and was affirmed as a final order on 7/3/2013, with respect to a workplace located at 2729 Vinings Orchard Circle, lot # 5, Smyrna, GA 30080.  Hector Salamanca was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 943827, citation number 2, item number 1 and was affirmed as a final order on 11/18/2013, with respect to a workplace located at 4231 Hardy Avenue, Smyrna, GA 30080.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.  On or about October 28, 2014, employees were exposed to fall hazards of approximately 11 feet when the employees were installing siding on a house from a pump-jack scaffold with no bottom brace.       Hector Salamanca was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 891196, citation number 1, item number 1b and was affirmed as a final order on 7/3/2013, with respect to a workplace located at 2729 Vinings Orchard Circle, lot # 5, Smyrna, GA 30080.
