29 CFR 1926.403(b)(1): Examination. The employer shall ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined on the basis of the following considerations:    29 CFR 1926.403(b)(1)(iv): Heating effects under conditions of use.    a. Located at 8384 Laidbrook Place in New Albany, Ohio, temporary electric was supplied to the house through a single electrical cord that was connected directly to two electrical cord splitters. The connections created a condition where the cords could heat up and create a fire hazard.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a. Located at 8384 Laidbrook Place in New Albany, Ohio, employees were performing framing work from a makeshift wooden platform without the use of fall protection, exposing employees to a nine foot fall hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a. Located at 8384 Laidbrook Place in New Albany, Ohio, employees were preforming framing work at the leading edge of a new construction residential house without fall protection. Employees were exposed to an eleven foot fall hazard while framing the second floor exterior walls.     Jose Perez Construction LLC was previously cited for a violation of this occupational safety and health standard, which contained in the OSHA inspection number 791763, citation number 1, item number 2 and was affirmed as final order on January 9, 2013, with respect to a workplace located at 8032 Scarborough Hall Drive. New Albany, Ohio.

Suitability of equipment for an identified purpose may be evidenced by listing, labeling, or certification for that identified purpose.  a. Located at 8384 Laidbrook Place in New Albany, Ohio, three microwaves were stored on the outside of the house for employees to use during breaks. The microwaves were not approved and labeled for use in outdoor locations.
