29 CFR 1926.502(i)(3): All covers were not secured when installed so as to prevent accidental displacement by the wind, equipment, or employees:    Location 35th Floor, 585 8th Ave, New York, NY    On or about August 29, 2014    a). Employees were working on the 35th floor deck when one employee stepped back into a floor hole left exposed by an unsecured cover that became displaced.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    Location 585 8th Ave, New York, NY 10018    On or about august 29, 2014    a). Employees were moving materials from the 34th floor to the roof top (35th and Elevator Shed) via the elevator shaft that was under construction. Employees were exposed to falls in excess of 12 feet because they were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    Kenry Contracting Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 29 1926.501(b)(1), which was contained in OSHA inspection number 315038455, citation number 1, item number 4 and was affirmed as a final order on Sept 9, 2013, with respect to a workplace located at 2833 Ocean Parkway, Brooklyn, NY 11224.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    Location 585 8th Ave, New York, NY    On or About August 29, 2014.    A). Employees were performing a task at the leading edge of an exposed elevator shaft.  Employees were never trained in the use of Fall protection or fall hazard recognition by the employer.    Kenry Contracting Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 29 1926.503(c), which was contained in OSHA inspection number 315038455, citation number 1, item number 4 and was affirmed as a final order on Sept 9, 2013, with respect to a workplace located at 2833 Ocean Parkway, Brooklyn, NY 11224.
