29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    On or about October 29, 2014, at BJ Brew House & Restaurant, the employer failed to ensure that employees wore protective helmets where work was being performed overhead. Employees were installing thin brick on the corner of the building.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed  according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91m) wide.    On or about October 29, 2014, at BJ Brew House & Restaurant, the employer did not ensure that the scaffold system was tied into the structure as recommended by the manufacturer.  Employees were installing thin brick from the scaffold system that was approximately 28 feet in height.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.     On or about October 29, 2014, at BJ Brew House & Restaurant, the employer did not ensure that the scaffold system was complete with a means of access and egress. Employees gained access to the scaffold by means of the metal frame.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.    On or about October 29, at BJ Brew House & Restaurant, the employer failed to ensure that  scaffolding was dismantled or altered by a trained and experienced employee. Employees of World of Masonry, Inc. altered the scaffolding while employees were using the scaffold to install thin brick on the corner of the building.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    On or about October 29, 2014, at BJ Brew House & Restaurant, the employer did not ensure that a guardrail system was installed on all open sides and ends of the scaffold. Employees were using the scaffold to install thin brick to the corner of the building.    Instance 1) On the fourth tier the guardrail did not extend the full length of the scaffold.    Instance 2) On the third tier there was no guardrail on the open end of the scaffold. The existing position of the guardrail system was not adequate.
