29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a. On or about August 9, 2018, employer's masonry subcontractor crew leader operated the rough terrain extendable boom powered industrial truck onsite with an 10-foot long x 4-foot wide wooden covered pallet scaffold platform without guardrails that was on the forks but not securely attached to the forks or forklift, an employee without any fall protection was on and worked from the platform when operator moved the platform horizontally and vertically, exposed to 10-foot fall and struck-by hazards.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  a. On or about August 9, 2018, employer's masonry subcontractor employee applied waterproofing material on the north side exterior of building from an 10-foot long x 4-foot wide wooden covered pallet scaffold platform without guardrails that was on the forks but not securely attached to the forks of the rough terrain powered industrial truck without any fall protection systems, being exposed to 10-foot fall hazard.
