29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.   a) On October 1, 2014 and at times prior thereto; throughout site; employees were not wearing eye protection while operating equipment such as but limited to pneumatic nail guns exposing them to a struck by hazard while framing the residential home.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) On October 1, 2014 and at times prior thereto; roof area; employees framing a new residential home were observed walking the trusses and working on the outside wall without a personal fall arrest system in place to prevent them from falling 35 - 40 foot to ground level.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a) On October 1, 2014 and at times prior thereto; stairs west-side of garage; the stairs rising 40 inches used to access the interior of the residential home from the garage was not protected by railing on both open sides exposing employees to a potential fall hazard.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) On October 1, 2014 and at times prior thereto; second floor west-side; the six foot step ladders used to access the roof area were not tall enough to extend three feet above the working platform exposing them to a 10 foot fall hazard while using the ladder to access the roof or coming down from the roof.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step   a) On October 1, 2014 and at times prior thereto; second floor west-side; the six foot step ladders used to access the roof area were not tall enough to extend three feet which resulted in the employees using the top step while accessing the roof area or while stretching from the roof area to access the top of the ladder; exposing employees to a fall hazard of 10 feet to the second floor platform.
