29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) On or about 10/28/14, at the north end of an aluminum pik on the second level of a fabricated frame scaffold erected in front of the Tim Hortons Restaurant under renovation at 3816 Union Rd., Cheektowaga, NY: One employee was exposed to a potential fall of approx. 14 ft. 7 in. while installing trim board, and standing at the end of the single aluminum pik. No fall protection system was utilized to protect the employee. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 10/28/14, on the small section of the lower roof at the northeast corner of the Tim Hortons Restaurant under renovation at 3816 Union Rd., Cheektowaga, NY: One employee was exposed to a potential fall of approx. 15 ft. to the ground while standing on the roof and using an angle grinder to cut trim board. No fall protection system was utilized to protect the employee. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a ridgid support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the the ladder: a) On or about 10/28/14, at the north end of the aluminum pik on the second level of scaffolding erected in front of Tim Hortons Restaurant under renovation at 3816 Union Rd., Cheektowaga, NY: An employee was exposed to a potential fall of approx. 14 ft. 7 in. while using an extension ladder to access the single aluminum pik. The employee climbed the extension ladder up to the horizontal frame member that the pik was on, stepped off the ladder to the right, and up 6 inches onto the pik. The siderails of the ladder extended 14 inches above the horizontal frame member, and only 8 inches above the pik. NO ABATEMENT CERTIFICATION REQUIRED
