29 CFR 1910.28(d)(4):  Scaffold legs shall be set on adjustable bases or plain bases placed on mud sills or other foundations adequate to support the maximum intended load:  a.  On or about October, 31 2014, during the installation of storm windows the employer did not ensure the legs, posts, and/or frames of a Bil-Jax brand tubular welded frame  type scaffold, located on the north side of the work site were bearing on base plates or other adequate firm foundations.  Employees were working at a level with a height of approximately 28 feet above the ground.   b.  On or about October, 31 2014, during the installation of storm windows the employer did not ensure the legs, posts, and/or frames of a Bil-Jax brand tubular welded frame  type scaffold, located on the east side of the work site were bearing on base plates or other adequate firm foundations.  An employee was working at a level with a height of approximately 22 feet above the ground

29 CFR 1910.28(d)(3): Scaffolds were not properly braced by cross bracing or diagonal braces, or both, for securing vertical members together laterally, and the cross braces shall be of such length as will automatically square and aline vertical members so that the erected scaffold is always plumb, square, and rigid. All brace connections were not made secure:  a.  On or about October, 31, 2014, during the installation of storm windows the employer did not ensure the frames and panels on a Bil-Jax brand tubular welded frame type scaffold, located on the north side of the work site, were braced with cross, horizontal or diagonal bracing.  Employees were working on the scaffold at a height of approximately 28 feet above ground level.   b.  On or about October, 31, 2014, during the installation of storm windows the employer did not ensure the frames and panels on a Bil-Jax tubular welded frame scaffold, located on the east side of the work site, were braced with cross, horizontal or diagonal bracing.  Employees were working on the scaffold at a height of approximately 22 feet above ground level.   CHURCH ART GLASS, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.452(c)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 98908, CITATION NUMBER 01, ITEM NUMBER 005, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 2, 2011 WITH RESPECT TO A WORK PLACE LOCATED AT 149 SOUTH MAIN STREET, WELLINGTON, OHIO.

29 CFR 1910.28(d)(7): Guardrails not less than 2 x 4 inches or the equivalent and not less than 36 inches or more than 42 inches high, with a mid-rail, when required, of 1- x 4-inch lumber or equivalent, and toeboards, were not installed at all open sides on all scaffolds more than 10 feet above the ground or floor:  a.  On or about October, 31 2014, during the installation of storm windows the employer did not ensure employees working from a Bil-Jax brand tubular welded frame type scaffold, located on the north side of the  work site were protected from falling by guardrails, personal fall arrest, or other fall protection systems.  The employees were working from a height of approximately 28 feet above the ground.     b.  On or about October, 31 2014, during the installation of storm windows the employer did not ensure all the working levels of a Bil-Jax brand tubular welded frame type scaffold, located on the east side of the work site was fully planked or decked.  An employee was working at a level with a height of approximately 22 feet above the ground.    CHURCH ART GLASS, INC. 29 CFR 1910.28(d)(9): The scaffold was not secured to the building or structure at intervals not to exceed 30 feet horizontally and 26 feet vertically:  On or about October, 31, 2014, during the installation of storm windows the employer did not ensure a Bil-Jax brand tubular welded frame type scaffold, located on the east side of the work site was restrained from tipping by guying, tying and/or bracing.  An employee was working on the scaffold at a height of approximately 27 feet above ground level, at or above the 4:1 ratio or every 26 feet (7 foot wide scaffold base).      CHURCH ART GLASS, INC.
