29 CFR 1910.133(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) The employer did not ensure that employees working in the Bucket Wash Area wore the proper splash resistant eyewear. Employees were exposed to a chemical burn hazard from the potential splashing of the caustic chemical Adept which has a known pH of 13-14 while cleaning pumps. The employees were required to transfer full strength Adept to a larger container for mixing.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. a) On or about November 5, 2015, the employer failed to provide a written certification of hazard assessment of the bucket washing procedure that included the use of chemical splash goggles, a face shield, chemical protective boots, and chemical protective clothing or a rubber apron. Employees are exposed to chemical hazards.

29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required safety data sheets (SDSs) for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.) a) On or about November 5, 2014, the employer failed to ensure that electronic access to safety data sheets were readily available on the fifth floor where the bucket wash is located, the electronic terminal failed upon the supervisor attempting to access the SDSs upon request. Employees are required to work with chemicals including Adept which has a known pH of 13, and Divosan, could cause significant burn injuries if contacted, or if incorrectly mixed could product toxic gases.
