29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. The employer failed to notify OSHA of an employee in-patient hospitalization within 24 hrs. Employee suffered head injury on Aug 11, 2015 about 1430 and was transported via EMS to hospital for treatment and admitted the same day. The employer did not notify OSHA until Aug, 13, 2015 at 1100.
