Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fall and/or crushing hazards: Test Tank 9: On, or about, October 31, 2014, employees were required to stand on a platform provided for the test tank when it was suspended on four winch lines. The platform was not locked in place by pins or pawls to prevent movement.

29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards were not guarded with a standard railing: Test Tank 9: Adequate fall protection was not provided around the test tank opening.
