29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:      a) On or about 11/06/14 on the Longhorn Steakhouse construction site at 1965 Military Rd., Niagara Falls, NY:   Employees installing stonework on a construction site were not trained to recognize potential hazards on this type of jobsite,  including but not limited to fall hazards when working on scaffolding and other surfaces,  and the need for personal protective equipment  such as but not limited to hard hats and safety glasses  to protect them from various hazards.  They also were not trained in the applicable OSHA regulations to control or eliminate these hazards.          ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a) On or about 11/06/14, outdoors, on the tubular welded frame scaffold erected just to the west of the window canopy on the south side of the Longhorn Steakhouse under construction at 1965 Military Rd., Niagara Falls, NY:   Employees installing stonework were exposed to a potential fall of approx.  14 ft.  from the west and east ends,  and from the south side of a single scaffold  plank running parallel to the  building, and about 1 ft. below the third level of the scaffold.  No guardrails or other fall protection system was used to protect employees on the scaffold platform.        b) On or about 11/06/14, outdoors, on the tubular welded frame scaffold erected just to the east of the window canopy on the south side of the Longhorn Steakhouse under construction at 1965 Military Rd., Niagara Falls, NY:   Employees installing stonework were exposed to a potential fall of approx. 14 ft.  from the west and east ends,  and from the south side of a single scaffold  plank running parallel to the  building, and about 1 ft. below the third level of the scaffold.  No guardrails or other fall protection system was used to protect employees on the scaffold platform.        c) On or about 11/06/14, outdoors, between the tubular welded frame scaffold erected just to the west of the window canopy and the tubular welded frame scaffold erected just to the east of the window canopy on the south side of the Longhorn Steakhouse under construction at 1965 Military Rd., Niagara Falls, NY:   Employees installing stonework were exposed to a potential fall of approx. 14 ft.  from the  south side of a single scaffold  plank running parallel to the  building and spanning  the  approx. 15 ft. gap between the scaffold erected on the west end of the window canopy  and the scaffold erected on the east end  of the window canopy. The plank was about 1 ft. below the third level of the scaffolds.  No guardrails or other fall protection system was used to protect employees on the scaffold plank.         NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:   a) On or about 11/06/14, outdoors, on the tubular welded frame scaffold erected just to the west of the window canopy on the south side of the Longhorn Steakhouse under construction at 1965 Military Rd., Niagara Falls, NY:   Employees installing stonework were exposed to a potential fall of approx.  14 ft.  from the north and south sides of the single scaffold  plank running parallel to the  building, and about 1 ft. below the third level of the scaffold.  The work level was not planked as fully as possible.   b) On or about 11/06/14, outdoors, on the tubular welded frame scaffold erected just to the east of the window canopy on the south side of the Longhorn Steakhouse under construction at 1965 Military Rd., Niagara Falls, NY:   Employees installing stonework were exposed to a potential fall of approx. 14 ft.  from the north  and south sides of a single scaffold  plank running parallel to the  building, and about 1 ft. below the third level of the scaffold.  The work level was not planked as fully as possible.   c) On or about 11/06/14, outdoors, between the tubular welded frame scaffold erected just to the west of the window canopy and the tubular welded frame scaffold erected just to the east of the window canopy on the south side of the Longhorn Steakhouse under construction at 1965 Military Rd., Niagara Falls, NY:   Employees installing stonework were exposed to a potential fall of approx. 14 ft.  from the  south side of a single scaffold  plank running parallel to the  building and spanning  the  approx. 15 ft. gap between the scaffold erected on the west end of the window canopy  and the scaffold erected on the east end  of the window canopy. The plank was about 1 ft. below the third level of the scaffolds.  The work level was not planked as fully as possible.   NO ABATEMENT CERTIFICATION REQUIRED
