Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. of implementing any of those systems. (a). At 30040 Five Farms Avenue, employees performing roofing work on a 5:12 pitched roof were not protected from falling in that no conventional or alternative fall protection system was used as required exposing them to a fall hazard greater than 10 feet from the eave of the roof to the ground below, on or about November 3, 2014.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a). At 30040 Five Farms Avenue, employees were exposed to a fall hazard in that the extension ladder used to gain access to the roof where work was being performed was not positioned 3 feet above the roof access point but only 18 inches, on or about November 3, 2014.
