29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition and the regulation applicable to his work environment to control or eliminate any hazard or other exposure to illness or injury: On or about November 7, 2014 and times prior thereto, at the workplace located at or near the Quality Inn, 196 E. Van Buren, Eureka Springs, Arkansas, an employee operated an aerial lift without receiving safety training or instructions prior to raising it to a height of approximately 20 feet above the ground below to paint a building. This condition exposed the employee to the hazard of falls from an elevation.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee working from an aerial lift: On or about November 7, 2014 and times prior thereto, at the workplace located at or near 196 E. Van Buren, Eureka Springs, Arkansas, an employee performed building painting from an aerial lift approximately 20 feet above the ground below without fall protection. This condition exposed employees to the hazard of falls from an elevation.
