29 CFR 1910.28(a)(1): Scaffolds were not furnished and erected in accordance with this standard for persons engaged in work that cannot be done safely from the ground or from solid construction, except that ladders used for such work shall conform to 1910.25 and 1910.26. (a) K&M Tire, Inc. on or about November 10, 2014, at the address of 965 Spencerville Rd. Delphos, OH: The employer failed to assure that work that cannot be done safely from the ground, or from solid construction, was done from a mobile work platform such as, but not limited to; a mobile ladder stand or rolling scaffold. Employees were climbing the structural members of the racking system to gain access and stand on the 4 ft. levels during tire stocking and pulling activities. K&M Tire, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.28(a)(1), which was contained in OSHA inspection number 313787327, citation number 1, item number 1b and was affirmed as a final order on July 19, 2011, with respect to a workplace located at 1125 Spencerville Rd. Delphos, OH.
