29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck was dismounted and within 25 feet of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement:  Magnolia Advanced Materials, Inc. - on or about February 24, 2015, an industrial truck operator and others in the area were exposed to struck-by hazards when the operator dismounted the industrial truck, leaving the load on the forks raised and tilted forward to drain product from the load (a mixing pot) into smaller containers.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates or markings were maintained in a legible condition:  Magnolia Advanced Materials, Inc. - on or about February 24, 2015, where employees operated forklifts to transport and stack materials in the production and packaging areas of the facility, the employer did not maintain nameplates in a legible condition.  a)  Yale G Type industrial truck.  b)  Toyota Model 5FGC25.  c)  Mitsubishi Model FGC15K.
