29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a) A. Duie Pyle/ 5000 Industrial Drive, Carteret, NJ - Truck Yard: Employees were not required to wear high visibility vests when exposed to vehicle traffic while making rounds and checking the trailers in the yard. Observed on/or about 11/24/2014.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): a) A. Duie Pyle/ 5000 Industrial Drive, Carteret, NJ - Truck Yard: The employer's documented Job Hazard Analyses (JHA) dated 7/2/2010 did not consider all job functions such as but not limited to Terminal Yard Workers, and Fuelers. Hazardous conditions and Personal Protective Equipment (PPE) such as but not limited to vehicle traffic/movement and employee visibility were not addressed. Employees are required to walk across the terminal's truck yard to perform daily checks, pick up new propane cylinders and fueling operations. Condition noted on/or about 11/24/2014.
