29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    Workers were observed engaged in commercial construction activities  removing and installing a gutter system on an existing tire manufacturing facility. A worker who utilized a Genie S-40, articulating, extensible, boom aerial lift was exposed to potential 20.0 foot fall hazards in that the worker was not attached to the basket or mast.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.      Workers were observed engaged in commercial construction activities  removing and installing a gutter system on an existing tire manufacturing facility. A worker who was removing existing gutters and tossing gutters to ground area was exposed to potential 20.0 foot fall hazards in that the worker was not utilizing a proper fall protection system.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.     Workers were observed engaged in commercial construction activities removing an existing gutter system and installing a new gutter system. A worker who utilized a Genie S-40 articulating, extensible, boom aerial lift was exposed to potential 20.0 fall hazards and was not properly trained in proper hazard recognition and fall protection procedures.

A worker was exposed to 20.0 foot fall hazards and was not properly trained in proper fall protection criteria.

29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.    Located along the side area of an existing manufacturing facility, workers were engaged in commercial construction activities removing an existing gutter system and installing a new gutter system. The Grover gutter machine and DeWalt cutoff saw operator was exposed to electrocution hazards in that the electrical service provided was connected with a 100.0 orange extension cord  plugged into a receptacle that was not GFCI protected and an assured equipment grounding program was not in use.
