29 CFR 1910.217(c)(3)(i)(b): Point of operation device did not prevent the operator from inadvertently reaching into the point of operation, or withdrawing his hands if they are inadvertently located in the point of operation, as the dies close:  a) American Posts, LLC - Toledo, Ohio: On or about November 18, 2014, the employer did not ensure that employees who operated the Cincinnati 9-150 mechanical power press (s/n 29021) were protected from crushing and amputation hazards in that point of operation devices did not protect the operator.  An employee sustained crushing injuries to the hand in that point of operation devices did not prevent the operator from inadvertently reaching into the point of operation as the press dies closed.

29 CFR 1910.217(e)(1)(ii): Each press was not inspected and tested at least weekly to determine the condition of the clutch/brake mechanism, antirepeat feature and single stroke mechanism.  The employer shall maintain a certification record of inspections, tests and maintenance work which includes the date of the inspection, test or maintenance; the signature of the person who performed the inspection, test, or maintenance; and the serial number or other identifier of the press that was inspected, tested or maintained.    a) American Posts, LLC - Toledo, Ohio: On or about November 18, 2014, the employer did not ensure that the Cincinnati 9-150 mechanical power press (s/n 29021) was inspected and tested to determine the condition of the clutch/brake and antirepeat feature.  The employer has no record of inspections for the press which would identify deficiencies with safe guarding methods.

The original and continuing competence of personnel servicing power presses was not maintained in that employees operated a press that was not inspected and guarded properly.
