On or about December 10, 2014, an employee was allowed to use a 3M tekk elastomeric half face respirator on a voluntary basis while handling chemicals at the pool area and the employer had not established nor implemented those elements of a respiratory protection program that would ensure the employee was medically able to use a respirator and provided with training on how to clean, store, and maintain the respirator.
