29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a.      On or about December 10, 2014, an employee was allowed to use a 3M tekk elastomeric half face respirator on a voluntary basis while handling chemicals at the pool area and the employer had not established nor implemented those elements of a respiratory protection program that would ensure the employee was medically able to use a respirator and provided with training on how to clean, store, and maintain the respirator.

On or about December 10, 2014, at the pump room, the employer did not ensure that a portable fire extinguisher was maintained in a fully charged and operable condition, exposing employees to bodily injuries from delays in accessing operational fire protection equipment in the event of a fire emergency.

On or about December 10, 2014, employees working with chemicals were potentially exposed to hazardous materials such as but not limited to muriatic acid, soda ash, regal skimmer sticks, bromine, and bleach. The employer had not developed nor implemented a written hazard communication program.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  a.       On or about December 10, 2014, the employer did not provide the information and training on the new label elements and the new Safety Data Sheet format to employees who had exposure to hazardous materials such as but not limited to muriatic acid, soda ash, regal skimmer sticks, bromine, and bleach.
