Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) On or about December 9, 2014, for an employee exposed to fall hazards while accessing a fixed ladder to gauge an upright flowback tank where the first rung was approximately 30 inches from the ground approximately three miles east of Highway 85 in Alexander, North Dakota.
