29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  JOB SITE: 604 Fairmont Street, Steele, MO 63877, on or about 12/11/2014, at this new residential construction site, workers were observed on top of a 10:12 pitch roof, approximately 9 feet 4 inches eave to ground level, actively installing new roof shingles, operating pneumatic nail guns without any form of eye or face protection.  The workers were exposed to a struck-by hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   JOB SITE: 604 Fairmont Street, Steele, MO 63877, on or about 12/11/2014, at this new residential construction site, workers were observed on an 10:12 pitch roof, approximately 9 feet 4 inches eave to ground level, actively installing new roof shingles, and were not adequately protected under the provision of paragraph 1926.501(b).  The workers were wearing body belts as personal fall arrest systems.  Effective January 1, 1998, body belts are not acceptable as part of a personal fall arrest system. (Note: the use of a body belt in a positioning device system is acceptable and is regulated under paragraph (e) of 29 CFR 1926.502). An employee who uses a body belt as a personal fall arrest system is exposed to hazards such as falling out of the belt, serious internal injuries, and technical asphyxiation through prolonged suspension.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:  JOB SITE: 604 Fairmont Street, Steele, MO 63877, on or about 12/11/2014, at this new residential construction site, workers were observed using a Werner Aluminum Extension Ladder, Model: D-1124-2, Light Duty Type III, 200 Lbs. load capacity and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed.

29 CFR 1926.1053(b)(4): 29 CFR 1926.1053(b)(4): Ladders were not used for purposes other than the purpose for which they were designed:  JOB SITE: 604 Fairmont Street, Steele, MO 63877, on or about 12/11/2014, at this new residential structure, workers were observed using a Werner Aluminum Extension Ladder, Model: D1124-2, 200 lb load capacity, was pulled apart into two (2) separate ladders and was used on the north and west side to the structure to access/egress onto the roof.
