29 CFR 1926.300(b)(4)(ii): The point of operation of machine(s) whose operation exposed an employee to injury was not guarded:    The employer does not guard all the rotating parts of machines to protect the operator and other employees in the construction area.      a. This violation was observed on or about December 15, 2014, on the construction site where an employee was exposed to struck-by and caught-by hazards when operating a Makita brand circular saw without a guard.       b. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all machines that have exposed rotating parts are guarded.

29 CFR 1926.451(b)(1): 29 CFR 1926.450(b)(1):  Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports.    The employer does not ensure that each platform on all working levels of scaffolds is fully planked or decked between the front uprights and the guardrail supports.  This violation was observed on or about December 15, 2014 when employees were exposed to a fall hazard while doing cornice work from a wood scaffold an elevated level of a residential structure without it being fully planked.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all working levels of scaffolds are fully planked or decked between the front uprights and the guardrail supports.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.    The employer does not protect employees on scaffolds from falling when working more than 10 feet above lower levels.  This violation was observed on or about December 15, 2014, at the job site where employees was exposed to an approximate 15 foot fall hazard when working from an elevated scaffold platform without being protected from falling.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when working on scaffolds 10 feet or more above lower levels.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed.    The employer does not ensure that a portable ladder was used for the purpose in which it was designed. This violation occurred on or about December 15, 2014, at the jobsite where an employee was exposed to a fall hazard when using an 8 foot step ladder to gain access to the framed roof for which it was not designed.     Pursuant to 29 C.F.R. 1903.19, within one (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders used by employees are used for the purpose for which they were designed.
