29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:     Mixer known as B-9 did not have a danger sign or by equally effective means to identify that the mixer is a permit required confined. Employees were exposed to entering this space without proper protection and being struck by moving parts. Employees were exposed to death or permanent disability.      Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903(c).

29 CFR 1910.146(h)(1): The employer did not ensure that all authorized entrants knew the hazards that could be faced during entry, including information on the mode, sign or symptoms, and consequences of the exposure:    The employee who enters the mixer known as "B-9" did not understand the permit and safety precautions before entering the confined space. The space contained spinning and rotating paddles by a motor could seriously injure or kill unauthorized entrants that had not followed the PRCS entry safety pre-cautions     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.146(k)(1)(v): Provide the rescue team or service selected with access to all permit spaces from which rescue may be necessary so that the rescue service can develop appropriate rescue plans and practice rescue operations.     The employer did not have employees trained in rescue and did not have rescue equipment available to rescue an employee. The employers policy was to call 911 to rely on outside personnel and not to enter the confined space. The company did not have the fire department visit the facility and evaluate the site and pre-plan if a rescue would occur.   In the event of a need for rescue injury severity would be increased due to delay in rescue.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.212(a)(2): General requirements for machine guards. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself.    In the old building the guard(s) to protect the employees from entering into the hopper area, employees were exposed to being caught in running parts.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.254(b)(4)(iv): Terminals for welding leads were not protected from accidental contact by personnel or metal objects:    In the new building employees were using the Lincoln Electric Idealarc 250 and were exposed to indirect contact where the welding leads connect to the machine.
