29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.    a) On or about December 23, 2014, the employer failed to have medical evaluation of employees required to wear tight fitting half face respirators. Respirators use can places a physiological burden on an employees. Without completing medical evaluation to determine an employees ability to use a respirator before requiring its use, an employer could be placing an employee at risk; by stressing the individuals pulmonary and cardiovascular systems which can lead to heart attack or stroke.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use    On or about December 23, 2014, Selmco Metal Fabricators, Inc. failed to develop and implement a written respiratory protection program when they required the use of half face tight fitting respirators for employees working with hazardous chemicals containing toluene-2,4-diisocyanate which can cause nervous system depression and adverse chronic effects in the following organ and systems: liver, urinary system, hematopoietic system and sensitization.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT).    a) On or about December 23, 2014, the employer failed to administer a fit test when employees were required to wear half face tight fitting respirator. Failure to administer a fit test exposes employees to a improper fitting respirator which can lower the protection factor and expose employee to the hazards it was intended to prevent. Employees worked with hazards chemicals such as toluene-2,4-diisocyanate which can cause nervous system depression and adverse chronic effects in the following organ and systems: liver, urinary system, and hematopoietic system.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.    a) On or about December 23, 2014, the employer failed to develop and implement a hazard communication program which at least describes how the criteria for: labeling,other forms of warning, safety data sheets and employee information and training will be met. the program should have also included a list of the hazardous chemicals known to be present as well as the methods the employer will be use to informed employees of the hazards of non-routine tasks. Employee working at Selmco Metal Fabricators, Inc. worked with hazardous chemicals such as Polane Catalyst (V66V27) and Polane Plus Catalyst (V66V47) which contained toluene-2,4-diisocyanate which can cause nervous system depression, sensitization and adverse chronic effects in the following organ and systems: liver, urinary system, hematopoietic system.

Salmco Metal Fabricators, Inc. failure to label hazardous chemicals in the workplace exposes employees to the hazards of the unlabeled chemical and could prohibit or delay the retrieval of information or treatment in the event of an emergency.
