A scaffold plank on the tubular welded frame scaffold was not capable of supporting, without failure, its own weight and at least four times the maximum intended load applied to it as the plank broke under the weight of a subcontractor's worker. 29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a)  12 Metzger Drive, West Orange, NJ.  The controlling employer did not provide for fall protection through adequate guardrails or other means when subcontractor employees were working on the balcony exposing them to a fall of approximately 10 feet to the ground below.                                              Violation observed on or about 12/18/2014.

Subcontractor's employee was exposed to falls as the first level of the tubular welded frame was not fully planked or decked between the front uprights and the guardrail supports.                                                Violation observed on or about 12/18/2014.    Tekcon Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(b)(1), which was contained in OSHA inspection number 820581, citation number 1, item number 1a and was affirmed as a final order on June 3, 2013, with respect to a workplace located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ.

Concrete blocks which are not a firm foundation for scaffold legs were used under the legs of the tubular welded frame scaffold to support the scaffold exposing subcontractor employees to injury from a scaffold collapse.                                                  Violation observed on or about 12/18/2014.    Tekcon Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(c)(2), which was contained in OSHA inspection number 820581, citation number 1, item number 1c and was affirmed as a final order on June 3, 2013, with respect to a workplace located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ.
