29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about 12/29/14 located at 1203 Firethorn Pass, Cumming, GA: Employees were installing 2x4s and fire proofing panels on an apartment complex that was under construction and were observed swinging the 2 x 4;s and panels overhead of the employees working below. Employees were without hard hats exposing them to a struck by hazards.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  On or about 12/29/14 located at 1203 Firethorn Pass, Cumming, GA:  Employees were observed installing fire proofing panels and lumber on the roof ridge top and end wall with a pneumatic nail gun and cutting lumber with a skill saw for the walls of a new apartment complex without safety glasses.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   On or about 12/29/14 located at 1203 Firethorn Pass, Cumming, GA:  Employees were exposed to 22.6 foot falls and struck- by hazard, while preforming framing work from the make shift walking / working surface 2x4 top plate. The employer failed to install guard rails and it was not fully decked.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)  NOTE TO CSHO: USE THIS OPTION ONLY IN CASES WHERE THE INFEASIBILITY/GREATER HAZARD EXCEPTION IS NOT IN ISSUE.  On or about 12/29/14 located at 1203 Firethorn Pass, Cumming, GA: An employee was installing 2x4s and fire proofing panels on the 2nd floor roof ridge top and the end wall while working at the edge, the employer did not ensure that fall protection was used by the employees while exposed to fall hazards of approximately up to 34.6 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about 12/29/14 located at 1203 Firethorn Pass, Cumming, GA: Employees were exposed to fall hazards, while performing framing work, employees were using a portable ladder to gain access to the roof and the 2nd floor, and the ladder was only 12.2 inches above the landing surface.
