29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a) 320 Route 73, Voorhees, NJ 08043: Employees working from two different aerial lifts were not using fall restraint equipment properly; lanyards were not adjusted to prevent employees from falling out of the aerial lift, on or about 12/29/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.454(c): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer shall retrain each such employee so that the requisite proficiency is regained. Retraining is required in at least the following situations: a) 320 Route 73, Voorhees, NJ 08043: Employees need to be trained or retrained; employees approximately 7-8 feet above ground level (floor level) were standing on the mid and top rails of the aerial lifts they were working from, on or about 12/29/14; b) 320 Route 73, Voorhees, NJ 08043: Employees were working from the mid and top rails of their aerial lifts without proper fall protection approximately 9-12 feet above ground level, on or about 12/29/14; c) 320 Route 73, Voorhees, NJ 08043: Employees working from aerial lifts while tack welding bar joists had not been trained or retrained when hired by their employer, on or about 12/29/14. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
