29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: a) Ira G. Steffy & Son, Inc., 460 Wenger Drive, Ephrata, PA 17522 - On or about May 17, 2023, the employer did not make audiometric testing available to the employees who were exposed to over the 8-hour time-weighted average sound level (TWA) of 85 decibels and were part of the company's hearing conservation program. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared: a) Ira G. Steffy & Son, Inc., 460 Wenger Drive, Ephrata, PA 17522 - On or about May 17, 2023, the employer did not make audiometric testing available to establish a baseline audiogram for the employees who were exposed to over the 8-hour time-weighted average sound level (TWA) of 85 decibels and who were part of the company's hearing conservation program. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
