29 CFR 1910.1001(j)(3)(i): Building and facility owners shall determine the presence, location, and quantity of ACM and/or PACM at the work site. Employers and building and facility owners shall exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM.    a.  On or about November 25, 2014, in the winding department, employees were exposed to asbestos when inspecting a motor which had been previously heated to temperatures of approximately 750 degrees Fahrenheit.  The employer failed to determine the presence, location and quantity of ACM and/or PACM or exercise due diligence at the work site prior to employees working with the friable material.

29 CFR 1910.1001(j)(5)(i): Labeling. Labels shall be affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers. When a building owner or employer identifies previously installed ACM and/or PACM, labels or signs shall be affixed or posted so that employees will be notified of what materials contain ACM and/or PACM. The employer shall attach such labels in areas where they will clearly be noticed by employees who are likely to be exposed, such as at the entrance to mechanical room/areas. Signs required by paragraph (j) of this section may be posted in lieu of labels so long as they contain the information required for labeling.    a.  On or about January 9, 2015, in the winding department, employees were exposed to ACM and/or PACM after a motor containing asbestos was examined on a table which resulted in residual ACM and/or PACM scrap, waste and debris to remain on the table.  The employer identified the ACM and/or PACM scrap, waste and debris but did not maintain labels and/or signs to notify employees of the hazard thereby exposing employees to the hazards associated with ACM.

29 CFR 1910.1001(j)(7)(iv): The employer shall also provide, at no cost to employees who perform housekeeping operations in an area which contains ACM or PACM, an asbestos awareness training course, which shall at a minimum contain the following elements: health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard relating to housekeeping, and proper response to fiber release episodes, to all employees who perform housekeeping work in areas where ACM and/or PACM is present. Each such employee shall be so trained at least once a year.      a.  On or about November 25, 2014, in the winding department, employees were exposed to asbestos when inspecting a motor which had been previously heated to temperatures of approximately 750 degrees Fahrenheit.  The employer had failed to provide adequate training to all employees who perform housekeeping in the winding area and the facility, which included at a minimum health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard relating to housekeeping, and proper response to fiber release episodes.

On or about January 9, 2015, in the winding department, employees were exposed to ACM and/or PACM after a motor containing asbestos was examined on a table in late November, 2014.  The employer failed to clean up the spill and release of ACM waste and debris as soon as possible.

Waste, scrap, debris, bags, containers, equipment, and clothing contaminated with asbestos consigned for disposal, shall be collected, recycled and disposed of in sealed impermeable bags, or other closed, impermeable containers.    a.  On or about January 9, 2015, in the winding department, employees were exposed to ACM and/or PACM after a motor containing asbestos was examined on a table in late November, 2014 leaving residual debris and contamination.  The employer failed to dispose of the ACM waste and debris in sealed impermeable bags.

29 CFR 1910.1001(k)(8): Waste and debris and accompanying dust in an areas containing accessible ACM and/or PACM or visibly deteriorated ACM, shall not be dusted or swept dry, or vacuumed without using a HEPA filter.    a.  On or about January 9, 2015, in the winding department, employees were exposed to ACM and/or PACM after a motor containing asbestos was examined on a table in late November, 2014.  The table containing debris contaminated with ACM and PACM had holes in it allowing the material to fall onto the floor where employees dry swept the floors.
