Location:        75 West End Avenue, New York, NY. Elevator Shaft.     a)  Supervisors did not enforce  the utilization of energy control procedures by employees as they worked in the elevator shafts on the elevators and associated equipment without implementing lockout tagout procedures.    On 1/9/15, an employee was working inside the elevator shaft, at the lobby level, Energy control procedures were not utilized on Elevators 7,8 and 9 when the employee worked in the shaft.

29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to Items of this section.  Location:    75 West End Avenue, New York, NY. Elevator Shaft.  a) The lockout tag-out procedures , for the work on the elevators and associated equipment,  did not clearly identify all of the specific steps to be followed by employees to isolate and de-energize the elevator system. The procedures provided by the employer by the P.S. Marcato Accident Prevention and Safety manual were general and did not contain a specific statement on the intended use of the procedure, did not contain specific procedural steps for the shutting down, isolating, blocking and securing the elevators and the associated equipment to control hazardous energy, did not contain specific procedural steps for the placement, removal and transfer of lockout devices and responsibility for them and did not contain specific requirements for testing the elevators and associated equipment to determine and verify the effectiveness of lockout devices and other energy control measures.  On 1/9/15, An employee was working inside the elevator shaft, at the lobby level, between shafts 8 and 9.  Elevators number 7 and 9 continued to operate in routine capacity while the employee was in the shaft.

Location:       75 West End Avenue, New York, NY. Elevator Shaft.    a) The employer did not conduct training for employees to provide them with the knowledge and skills required to safely apply, use and remove energy controls during the work on the elevator and associated equipment during the elevator modernization project.  On 1/9/15, An employee was working inside the elevator shaft, at the lobby level,. Training on the LOTO program and procedures were not utilitzed on Elevators 7,8 and 9 when an employee worked in the shaft.

Elevator Shaft.    a)    The employer did not establish a LOTO program to ensure that the elevators and  associated equipment  were not isolated from energy sources and rendered inoperative during the modernization of the elevators.  On 1/9/2015, an employee was working inside the elevator shaft, at the lobby level, between shafts at the lobby level. Elevators 7,8 and 9 were not locked out while the employee worked in the shaft.

Location:    75 West End Avenue, New York, NY. Elevator Shaft.    a)    On 1/9/2015 an employee was working inside the elevator shaft, at the lobby level. No form of fall protection was being utilized by the employee in the shaft.    P.S. Marcato Elevator Co., Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 1910.23(c)(1), which was contained in OSHA inspection number 902622, citation number 01, item number 01 and was affirmed as a final order on 12/02/2013, with respect to a workplace located at 61 Broadway,  New York, NY 10006.
