29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) Damar Products, Inc; On or about January 21, 2015, the employer failed to implement a hearing conservation program to control employees exposure to occupational noise. An employee operating the computer saw (Tiger Stop Version 5) was overexposed to noise at an 8 hour time weighted average of 90.6 dBA, which exceeded the action limit of 85 dBA.    b) Damar Products, Inc; On or about January 21, 2015, the employer failed to implement a hearing conservation program to control employees exposure to occupational noise. An employee operating a horizontal band saw and a planer was overexposed to noise at an 8 hour time weighted average of 90.7 dBA, which exceeded the action limit of 85 dBA.    c) Damar Products, Inc; On or about January 21, 2015, the employer failed to implement a hearing conservation program to control employees exposure to occupational noise. An employee operating a powered air gun was overexposed to noise at an 8 hour time weighted average of 92.3 dBA, which exceeded the action limit of 85 dBA.

29 CFR 1910.133(a)(2): The employer did not ensure that each affected employee used eye protection that provided side protection when there was a hazard from flying objects.    a) Damar Products; On or about January 14, 2015 the employer failed to ensure that each affected employee wearing prescription lenses were provided with eye protection that incorporates the prescription in its design. An employee operating a horizontal band saw was exposed to contact with flying particles, wood chips, in that employees wearing prescription lenses were not provided with safety glasses or side shield attachments that incorporate prescription lenses.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) Damar Products; On or about January 14, 2015 the employer failed to ensure that the rotating fan shaft of the local ventilation system attached to the notcher was properly guarded. Employees were exposed to caught in hazards while standing beside the unguarded rotating shaft to power on and off the notcher.    b) Damar Products; On or about January 14, 2015 the employer failed to ensure that the rotating shaft of the outdoor Clarage fan powering the dust collector was properly guarded. Employees were exposed to caught in hazards while walking past the rotating shaft to bring in new wood stock to be cut.
