29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     The employer does not protect employees from falling when working 6 feet or more above a lower level. This violation occurred on or about January 9, 2015, on the fifth floor of a multi-family dwelling, Building 4, Room #555, where employees were exposed to a 9 foot 6 inch fall hazard when installing trusses without a fall protection system.     Jose M. Aguilera dba JMA Carpenter was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 982659, citation number 01 item number 001 and was affirmed as a final order on July 24, 2014, with a final abatement date of July 22, 2014, with respect to a workplace located at 21801 Northwest Dr. Bldg. #2, Spring, TX 77379.     Jose M. Aguilera dba JMA Carpenter was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 315783779, citation number 01 item number 001 and was affirmed as a final order on May 11, 2012, with a final abatement date of March 27, 2012, with respect to a workplace located at 2500 S Millbend, The Woodlands, TX 77380.       Jose M. Aguilera dba JMA Carpenter was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 315724351, citation number 01 item number 001 and was affirmed as a final order on April 6, 2012, with a final abatement date of April 6, 2012, with respect to a workplace located at 11063 Southdown Trace Trails, Houston, TX 77072.
