29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection.  a) Roof, new residential construction located at 159 Nakamis Place, Milton, GA 30004: Employees were exposed to falls of approximately 24-feet, 3-inches while using inadequate fall protection systems (Mountain Climbing Harnesses) on a 10/12 pitched roof. The fall protection system lacked a full body harness with D-Ring, life-line, 5000 lbs. anchor point, shock absorbing lanyard and rope grab.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) Front side, new residential construction located at 159 Nakamis Place, Milton, GA 30004: The ladder provided was not secured to the structure and did not extend at least 3 feet above the working surface to allow for safe access on and off the roof. Employees accessing this ladder were exposed to falls of approximately 14-feet, 8-inches to the lower level.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) Roof, new residential construction located at 159 Nakamis Place, Milton, GA 30004: Employees were exposed to potential eye injuries while operating pneumatic Hitachi (Model-NV45AB2) Coil Roofing Nail Guns without eye protection. Employees firing 1-1/4-inch wire collated coil roofing nails at 120 PSI were not provided with protective eyewear.  Antonio Morales was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 952439, citation number 1, item number 1 and was affirmed as a final order on 03/03/2014, with respect to a workplace located at 3378 Ebenezer Farm Road, Marietta, GA 30062.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Roof, new residential construction located at 159 Nakamis Place, Milton, GA 30004: Employee was exposed to falls while engaged in residential roofing activities on a 10/12 pitched roof at eave heights of approximately 18-feet, 4-inches with no fall protection system in place.   Antonio Morales Adame was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 982290, citation number 1, item number 1 and was affirmed as a final order on 09/17/2014, with respect to a workplace located at 4072 Thorndale Lane, Smyrna, GA 30080.  Antonio Morales Adame was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 952439, citation number 1, item number 2 and was affirmed as a final order on 03/03/2014, with respect to a workplace located at 3378 Ebenezer Farm Road, Marietta, GA 30062.
