29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.  The employer does not provide a means of egress in trench excavations .  This violation was observed on or about January 20, 2015, at the excavation site where employees were exposed to falls when entering and exiting an excavation without a means of egress.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that  employees are protected from falls when entering and exiting excavations.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary    The employer does not ensure that equipment is at least 2 feet from the edge of excavation. This violation was observed on or about January 20, 2015, at the excavation site where employees were exposed to a struck-by or and crushed-by hazard when working in an excavation that had a Caterpillar excavator operating less than 2 feet from the edge of the excavation.    The Randy Roan Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.651(j)(2), which was contained in OSHA inspection number 980721, citation number 1, item number 1 and was affirmed as a final order on July 16, 2014, with respect to a workplace located at Texas 105 and Walden Road, Montgomery, Texas.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps to ensure that employees are protected from equipment or other materials from falling or rolling into the excavation.
