The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator in the workplace. On or about 21 January 2015, the employer did not provide medical evaluations for employees working in the penthouse who use respirators including the 3M N95 particulate respirator and Sperian full face respirator; to mix the buckets of calcium hydroxide (lime) required for the corn cooking process.

29 CFR 1910.151(c): 29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use. On or about 21 January 2015, the emergency eyewash station in the water treatment area was located more than 10 feet away from the tanks containing 300 gallons of 93% sulfuric acid and 500 gallons of caustic; exposing employees to hazards of corrosion, severe irritation or permanent damage to the eyes.
