29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder.     On or about January 23, 2015, the employer failed to provide standard railing or other means of equivalent protection for open sided floors and platforms, at the following locations:    a.) the Dryer platform walkway - along the side of the dryer,    b.) the Dryer platform walkway - at the end of the dryer,  c.) the 2nd floor at the magnetic separator - missing midrail,  d.) the elevator platform, and   e.) the Production Screen platform - two sections measuring two and one half feet were not protected.    Due to these conditions, employees have exposure to fall hazards of ten to greater than 20 feet.

29 CFR 1910.147(c)(4)(ii): Control of hazardous energy. Energy control procedure. The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, the elements required by 1910.147(c)(4)(ii)(A) - (D):     a. Steel Valley Firebrick, Irondale Ohio workplace: On or about April 10, 2015, the employer had not developed specific procedures for lockout/tagout of equipment in the Crushing line area/plant. The employer's written information for control of hazardous energy does not include specific procedural steps for shutting down, isolating, blocking and securing   machines or equipment to control hazardous energy; and does not include specific steps for lockout device placement, transfer, removal and designate the responsibility for lockout devices; does not include specific requirements for testing and verification of machines or equipment.  Employees perform required duties covered by this part on a daily basis including maintenance, repair and cleaning activities, such as when replacing, adjusting or repairing the hammer mill bars, cradle or hammer.

The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    On or about April 10, 2015, the employer had not established and documented powered industrial truck training programs, for operators of the equipment covered by this part including the Nissan propane forklift.

29 CFR 1910.1200(h)(3)(iv): Employee information and training.  Employee training shall include at least: The details of the hazard communication program developed by the employer, including and explanation of the labels received on shipping containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.    On or about the April 10, 2015, the employer had not performed training in the new GHS 2012 pictogram labeling requirements.
